College hazing is the practice of putting inductees of a fraternity, sorority, or other group through dangerous or humiliating activities before the group will let them join. It is an initiation process that many colleges and universities have on campus, typically without the school’s approval or knowledge. Hazing is far from a fun or harmless activity. It puts students in jeopardy of serious injuries. Students have been hospitalized and even killed during hazing rituals.

According to Statute §1801:

Hazing prohibited; penalties—-Hazing in any form, or the use of any method of initiation into fraternal organizations in any educational institution supported wholly or in part by public funds, which is likely to cause bodily danger or physical punishment to any student or other person attending any such institution is prohibited. Whoever violates the provisions of this Section shall be fined not less than ten dollars nor more than one hundred dollars, or imprisoned for not less than ten days nor more than thirty days, or both, and in addition, shall be expelled from the educational institution and not permitted to return during the current session or term in which the violation occurs.

Elements of a College Hazing Claim

First, you must show the defendant breached his or her duty of care to you. Hazing in any form is illegal under Louisiana law. This fact could be enough to prove negligence per se against the people who committed the hazing. If you’re suing the school, the breach of duty might be that the school failed to take steps to prevent hazing on campus.

Second, you need to prove causation between the defendant’s breach of duty and the hazing accident. You must show your injuries would not have happened but for the defendant’s actions.
